DİYARBAKIR - The prosecutor's office appealed against the acquittal of Green Left Party Şirnex MP Newroz Uysal in the case of "being a member of a terrorist organization".
The acquittal of Greens and Left Future Party (Green Left Party) Şirnex(Şırnak) MP Newroz Uysal, who is on trial for "being a member of a terrorist organization" because of the Whatsapp group formed by lawyers against violations of the curfews, 2 press releases, a Democratic Society Congress (DTK) delegate, and describing the isolation against his client, PKK Leader Abdullah Öcalan, in the panels he attended.
'THERE IS NO CONVINCING EVIDENCE'
In the reasoned decision of the Diyarbakir 10th High Criminal Court, it was stated that considering the number of 2 actions allegedly "turned into terrorist propaganda" by Uysal, they did not meet the criteria of diversity, intensity and continuity required for "being a member of a terrorist organization" in terms of quantity. In the reasoned decision, the messages in the WhatsApp group established by lawyers against rights violations during the curfews implemented in Cizre in 2015 and the speeches Uysal made at the panels he attended were evaluated as evidence, and it was noted that these messages were in the dimension of "sympathy for the terrorist organization". In the reasoned decision, which emphasized that Uysal's phone calls with her clients' relatives "do not constitute evidence of membership in a terrorist organization", it was stated that there was no concrete and convincing evidence, beyond any doubt, that Uysal was a DTK delegate, apart from the list in the file. In the verdict, it was stated that Uysal was acquitted because there was no concrete and convincing evidence, far from any doubt.
PROSECUTOR FILED AN APPEAL
Following the announcement of the reasoned decision, the Diyarbakır Public Prosecutor's Office filed an appeal with the Diyarbakır Regional Court of Justice, demanding that the acquittal decision was overturned and Uysal was sentenced to prison.
